DMCA Policy

Butternut Squash Pizza respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), the text of which may be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, Butternut Squash Pizza will respond expeditiously to claims of copyright infringement committed using the Butternut Squash Pizza service and/or the Butternut Squash Pizza website (the "Site") if such claims are reported to Butternut Squash Pizza's Designated Copyright Agent identified below.

Filing a DMCA Notice of Infringement

If you are a copyright owner, or are authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the Site by completing the following DMCA Notice of Alleged Infringement and delivering it to Butternut Squash Pizza's Designated Copyright Agent. Upon receipt of the Notice as described below, Butternut Squash Pizza will take whatever action, in its sole discretion, it deems appropriate, including removal of the challenged content from the Site.

  1. Identification of the copyrighted work claimed to have been infringed: Provide a description of the copyrighted work that you claim has been infringed. If multiple copyrighted works are covered by a single notification, provide a representative list of such works.
  2. Identification of the material that is claimed to be infringing or to be the subject of infringing activity: Provide a description of the material that you claim is infringing (or is the subject of infringing activity) and that is to be removed or access disabled, and information reasonably sufficient to permit Butternut Squash Pizza to locate the material (e.g., URL(s) where the material can be found on the Site).
  3. Information reasonably sufficient to permit Butternut Squash Pizza to contact you: Include your mailing address, telephone number, and, if available, an electronic mail address.
  4. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  6. Your physical or electronic signature: A digital signature is acceptable if it can be verified.

Filing a DMCA Counter-Notification

If you believe that your content that was removed (or to which access was disabled) is not infringing, or that you have the authorization from the copyright owner, the copyright owner's agent, or pursuant to the law, to post and use the material in your content, you may send a counter-notice containing the following information to Butternut Squash Pizza's Designated Copyright Agent:

  • Identification of the material that has been removed or to which access has been disabled: Provide the location (e.g., URL(s)) at which the material appeared before it was removed or disabled.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or a misidentification of the material in question.
  • Your name, address, telephone number, and email address.
  • A statement that you consent to the jurisdiction of the federal court in [Your State/Region, e.g., "California"] and a statement that you will accept service of process from the person who provided notification of the alleged infringement.
  • Your physical or electronic signature: A digital signature is acceptable if it can be verified.

Upon receipt of a valid counter-notification, Butternut Squash Pizza will forward it to the complaining party. If the complaining party does not file an action seeking a court order to restrain the user from engaging in infringing activity related to the material on Butternut Squash Pizza within 10-14 business days, then Butternut Squash Pizza may, in its sole discretion, reinstate the removed material.
